Terms of Service

This is a working draft, not a finished legal document. It has not yet been reviewed by a lawyer. It's published here so you know what the platform currently intends and does, but it should not be relied on as your final policy until a qualified lawyer (ideally one familiar with Kenya's Data Protection Act, 2019) has reviewed and signed off on it.

These terms govern a school's use of Edu Maisha ("the platform"). By registering a school, or by using an account created by a registered school, you agree to them.

1. What the platform is

Edu Maisha is school management software: admissions, academics (CBC), fee collection with M-Pesa, payroll, examinations, library, dormitory management, and a parent portal with SMS notifications. It's provided as a hosted service — the school doesn't install anything, and accesses it through a web browser at its own subdomain.

2. Registering a school

The person registering a school on the platform confirms they're authorized to do so on the school's behalf. Once registered and approved, the school receives one administrator account. That administrator is responsible for creating further staff accounts and assigning them appropriate roles — the platform deliberately limits what a school's own administrator account can do (it manages staff accounts and roles, not finances, exams, or timetables directly) so that operational authority sits with the specific roles built for each domain. It's the school's responsibility to assign roles sensibly and to remove access when someone leaves.

3. Payment and plans

Access to the platform requires an active, paid subscription — there is no free trial. Pricing is per student, per term, according to the plan selected at registration. Payment is made via M-Pesa. [Specific terms around what happens to data access during a payment lapse, refund policy, and exact plan terms should be finalized with legal input and cross-checked against Tenant::PLANS in the codebase, which is the source of truth for current pricing.]

4. Whose data it is

The school owns the student, staff, and guardian data it puts into the platform. Edu Maisha doesn't claim ownership of it, doesn't use it for any purpose beyond providing the service, and doesn't sell it. The platform is actively maintained, but is currently run as a single operator without a formal uptime guarantee or service-level agreement. We aim for high availability and will communicate planned maintenance in advance where possible, but the school should not treat the platform as having guaranteed 24/7 uptime at this stage. [As the platform matures — redundant hosting, monitoring, and a support process — this section should be revisited and, ideally, strengthened into a real SLA.]

7. Suspension and termination

We may suspend or terminate a school's access for non-payment, for a serious breach of the acceptable use terms above, or for unlawful use of the platform. A school may stop using the platform at any time; see the Privacy Policy for how long data is retained afterward.

8. Limitation of liability

The platform is provided "as is." To the extent permitted by Kenyan law, Edu Maisha isn't liable for indirect or consequential losses arising from use of the platform. [This clause in particular needs a lawyer's drafting — a placeholder like this is not something to rely on in a real dispute.]

These terms are governed by the laws of Kenya.
